Can Obama Legally be the President?

The following is from Steve. Please note that his views are not necessarily those of NotoriouslyConservative.com. For your consideration:

In case anyone is unclear about this criminal matter, let me explain. Donors parted with hundreds of millions of dollars based on the Obama camp's fraudulent representation that Obama had the basic qualifications, and good standing, to be a bona fide candidate. The people were duped and there are severe penalties for that. Try selling stock that way! If I sell you stock in my company and the prospectus fails to disclose information that is material to your investment decision, then I have committed securities fraud. That's why I paid lawyers two arms and a leg for my prospectus. It is that important.

Legal dictionary: "Fraud in the Inducement" n. the use of deceit or trick to cause someone to act to his/her disadvantage, such as signing an agreement or deeding away real property. The heart of this type of fraud is misleading the other party as to the facts upon which he/she will base his/her decision to act. Example: "there will be tax advantages to you if you let me take title to your property," or "you don't have to read the rest of the contract--it is just routine legal language" but actually includes a balloon payment.

Now, I realize that a political campaign is governed by different laws and regulations, so I cannot just apply this term of law to campaigning, however, the parallels are so very close ... close enough, I believe, to justify a decision on that basis. Now, since Obama was aware of the fraud from Day 1, he therefore had to stonewall people seeking real proof ... while he was banking all that money. If he had real support, why was it not produced sooner?

Legal dictionary: "Extrinsic Fraud" n. fraudulent acts which keep a person from obtaining information about his/her rights to enforce a contract or getting evidence to defend against a lawsuit. This could include destroying evidence or misleading an ignorant person about the right to sue. Extrinsic fraud is distinguished from "intrinsic fraud," which is the fraud that is the subject of a lawsuit.

Now, in this case, we have a pro-active, deliberate attempt to deceive. When I managed a brokerage/bank, the first thing I would tell new trainees is that "if you ever sign anyone else's name or even white out a signature, even if you think it won't matter, it is grounds for immediate termination. Only with a power-of-attorney can you represent someone with your signature". And we always got the power-of-attorney when we needed it. It is that important.

In securities fraud, an omission might be negotiable (i.e. "what constitutes materiality?") ; even a manifest mistake might be argued as a benign accident, however, forging or counterfeiting state documents is the most egregious form of fraud imaginable.

Legal dictionary: "Forgery" n. 1. a copy that is represented as the original [ syn: counterfeit ] 2. criminal falsification by making or altering an instrument with intent to defraud

According to the data I have, there is no doubt that this so-called Hawaiian Birth Certificate on Obama's web site is a naked forgery. Why does that matter? Well, because the donors, you and I have no legal access to Obama's birth records so, donors must rely upon the agents and organizations (government and/or the DNC) who best represent Obama as a bona fide candidate. Whether they actually have a duty to verify does not matter.

Legal dictionary: "Apparent Authority" n. since under the law of agency the employer (the principal) is liable for the acts of his employee (agent), if a person who is not an agent appears to an outsider (a customer) to have been given authority by the principal then the principal is stuck for the acts of anyone he allows to appear to have authority. This "apparent authority" can be given by providing Joe Slobovia (who has no authority to contract) with materials, stationery, forms, a truck with a company logo, or letting him work out of the company office, so that a reasonable person would think Joe had authority to act for the company. Then the contract or the price quote given by Joe and accepted by third party is binding on the company. Apparent authority may also arise when Joe works for the company, has no authority to contract, but appears to have been given that authority. Beware of the salesman who exceeds his authority or the hanger-on who claims to work for the boss. (See:
agency, ostensible authority)

Obama is not a bona fide candidate. Many will say "No harm, no foul". That won't fly here. The Constitutional provision is all about mitigating the expected damages of putting a quisling in office. And considering all of Obama's connections to terror, both here and abroad, there is indeed much to fear. And let's not forget that this alleged candidate has already committed the fraud of misrepresenting his birth on federal forms - applications and such. Thus, more reasons to fear. Good Lord ... Dear reader: Stop for a moment and ponder what I said: A presidential candidate forging state docs with intent to deceive voters as to his qualifications to be leader of the free world. Good God Almighty, this is not something we can just brush aside!.

And isn't just a little strange that some unaccomplished pal of the most notorious Anti-American terrorist in recent history can suddenly attract a record amount of money? ... and from so many unknown sources? Is it not reasonable to suspect that there may be dark schemes at hand, motivating people to part with such ungodly sums?... one with a Muslim upbringing, in a post-911 world? Lies about Obama's "Christianity" won't fly.

This man is very, very dangerous. Why does that sound so shocking? Because the media brain-washing machine has you hypnotized ... as planned.

If the courts do not uphold the plain and unambiguous language of the Constitution, then they have declared war on the people, and I will declare my candidacy in the upcoming special election that I will organize. Got that. Yes, if the courts are assuming the role of self-ordained tyrants, and making their own law without respect for America's safety, then we will go ahead and run our own election to supersede the fraudulent one now at hand.
